Expedited Trademark Procedures in Thailand: A Comprehensive Guide to Fast Track Options

The general timeline for trademark registration in Thailand, from filing to registration, usually takes about 12 to 18 months, depending on the complexity of the application and the examination workload at the Department of Intellectual Property (DIP).


However, many business owners wonder: is there a way to make it faster?


The answer is yes, but only if certain eligibility criteria are met. The DIP has introduced several Fast Track options designed to speed up the process for applicants who qualify. These expedited routes allow trademark owners to secure protection more quickly while maintaining compliance with DIP requirements.


Below is a summary of the current Fast Track options available to trademark owners in Thailand who wish to register their marks as quickly as possible.


1. Trademark Application Fast Track Options

There are generally two Fast Track options available for trademark applications filed with the DIP.


1.1 Standard Fast Track (6-Month First Office Action)

This option, often referred to as the “First Action Fast Track,” allows applicants to receive the first examination result within six months instead of the usual 10-12 months.


To qualify, the application must meet all of the following conditions:

  • The list of goods or services must not exceed 50 items.

  • All items must conform to the DIP’s approved list of goods and services.

  • No amendments, assignments, or supporting documents can be filed after submission.


This is the most recommended route for general applicants, particularly those focusing on key trademarks covering non-complicated goods or services, or for businesses filing for the first time that wish to secure registration efficiently under standard conditions.


1.2 Fast Track for Urgent Use (4-Month First Office Action)

The Fast Track for Urgent Use option further reduces the first examination result to around four months, but it is available only in specific cases where the mark is urgently needed for immediate business or regulatory use.


To qualify, applicants must meet the following requirements:

  • File exclusively via the DIP e-Filing system.

  • The application must cover only one class (Single Class Application) and include no more than 10 items of goods or services from the DIP’s approved list.

  • Submit all supporting documents at the time of filing, including a declaration of urgent necessity and similarity search reports.

  • No amendments or additional documents may be filed after submission.


Examples of qualifying cases include:

  • When the trademark is required for use in applications with government agencies, such as the Food and Drug Administration (FDA) or the Department of Agriculture.

  • When the trademark is needed for export purposes or imminent business operations that require official trademark documentation supported by a clear and concrete business plan.


2. Seasonal Special or Limited-Time Fast Track Programs

From time to time, the DIP introduces special Fast Track schemes during certain periods. For example, the “New Year Expedited Processing Program” launched in late 2024 to celebrate the 2025 New Year season.


Under that limited-time campaign, applicants who filed between December 15, 2024, and January 31, 2025, could receive first examination results within three months, provided they met simplified requirements (single class application, limited number of items, and full supporting documents).


While such programs are not permanent, they show the DIP’s commitment to making IP services more efficient and business-friendly. Similar seasonal or event-based fast track opportunities may be offered in the future.


3. Upcoming Development: Fast Track for Online Product Trademarks

Looking ahead, the Department of Intellectual Property has recently announced plans to expand its Fast Track service even further. According to Ms. Oramon Sapthaweetham, Director-General of the DIP, in a press release issued in October, the DIP aims to introduce in 2026 a new Fast Track channel for trademarks used with products sold online through digital platforms.


At this stage, it is not yet confirmed whether this new channel will be part of the Fast Track for Urgent Use program or established as a separate scheme. Nonetheless, the development reflects the DIP’s recognition of the growing importance of e-commerce and digital trade in Thailand’s economy.


4. Renewal Fast Track Option

In addition to application filing, the DIP also offers a Renewal Fast Track option to help trademark owners renew their registrations more quickly.


To qualify, the renewal application must meet these conditions:

  • The renewal covers no more than 30 items of goods or services.

  • No changes are made to the list of goods or services of the trademark being renewed

  • The renewal fee is paid in full.

  • The Renewal Fast Track request is submitted at the same time as the renewal application.


This enables trademark owners to complete their renewal process in a much shorter timeframe compared to the conventional route.
